1. About These Terms
These Terms and Conditions (“Terms”) govern your use of the services provided by MPF Inspections Group (“we”, “us”, “our”), including building inspections, construction stage inspections, dilapidation reports, depreciation schedules, and pool barrier safety inspections.
By engaging our services or requesting a booking, you agree to be bound by these Terms. Please read them carefully before proceeding.
2. Our Services
We provide the following building inspection and consultancy services in Melbourne and surrounding areas:
- Pre-purchase building and pest inspections
- New construction stage inspections
- Dilapidation report inspections
- Depreciation schedules
- Pool barrier safety inspections
- DIY inspection guidance
The scope of each inspection is limited to accessible areas and visible elements of the property at the time of inspection. We do not open walls, ceilings, or concealed areas, and our inspections are non-invasive.
3. Bookings and Fees
A booking is confirmed upon receipt of your request and our written or verbal confirmation. Fees are quoted prior to engagement and are payable as agreed. We reserve the right to adjust fees for properties that are significantly larger or more complex than described at the time of booking.
Payment is due prior to or at the time of the inspection unless otherwise agreed in writing.
4. Cancellations and Rescheduling
If you need to cancel or reschedule your booking, please provide at least 24 hours notice. Cancellations made with less than 24 hours notice may incur a cancellation fee. Where access to the property cannot be arranged through no fault of our own, we reserve the right to charge a call-out fee.
5. Inspection Reports
Inspection reports will be delivered to you electronically on the same day as the inspection, or within the timeframe agreed at booking. Reports are prepared for the exclusive use of the client who engaged us and must not be relied upon by third parties without our written consent.
Reports reflect the condition of the property at the time and date of inspection only. Conditions may change after the inspection, and we are not responsible for changes that occur after the inspection date.
6. Limitations of Inspection
Our inspections are visual and non-invasive. We do not:
- Open, remove, or damage any part of the property
- Inspect areas that are not safely or reasonably accessible
- Test electrical, plumbing, gas, or mechanical systems in detail (unless specifically engaged to do so)
- Provide structural engineering assessments or certifications
- Inspect items concealed by furniture, floor coverings, or stored goods
Where we identify a concern that may require further investigation, we will note this in our report and may recommend engagement of a relevant specialist.
7. Limitation of Liability
To the maximum extent permitted by law, our total liability to you for any claim arising from or in connection with our services is limited to the fee paid for the relevant inspection.
We are not liable for any indirect, consequential, special, or incidental loss or damage, including loss of profit, loss of opportunity, or the cost of remediation works, arising from reliance on our report or any error or omission contained in it.
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition implied or imposed by the Australian Consumer Law that cannot be excluded or limited by agreement.
8. Independent Advice
MPF Inspections Group is engaged solely by the client. We do not act on behalf of, and are not influenced by, any real estate agent, vendor, builder, developer, or other party involved in the property transaction. Our reports reflect our independent professional assessment.
9. Reliance on Report
Our report is prepared to assist you in making an informed decision about a property. It is not a guarantee of the property’s condition, and it should not be used as the sole basis for a purchasing or contracting decision. We recommend you seek independent legal and financial advice as appropriate.
10. Intellectual Property
All inspection reports, documents, and materials produced by us remain our intellectual property. You are granted a licence to use the report for your own personal or business purposes. Reports must not be reproduced, published, or distributed without our written consent.
11. Privacy
We handle your personal information in accordance with our Privacy Policy, available on our website. By engaging our services, you consent to the collection and use of your information as described in that policy.
12. Governing Law
These Terms are governed by the laws of the State of Victoria, Australia. Any disputes arising from these Terms or our services will be subject to the exclusive jurisdiction of the courts of Victoria.
13. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on our website with a revised date. Continued use of our services after any changes constitutes acceptance of the updated Terms.
